    WHAT ARE TERMS & CONDITIONS?

    Terms and Conditions are a set of rules and guidelines that a user must agree to in order to use IPHF-owned websites and mobile apps. It acts as a legal contract between IPHF who owns the websites or mobile apps listed below, and you the user, who accesses our websites and/or mobile apps.

    • IPHF’s websites and its apps are not intended for use by or targeted at children under 16, and we do not knowingly or intentionally collect information about children under 16.

    • IPHF is a U.S.-based association and its membership benefits and practices are U.S.-centric and while we do have members in 50+ countries, we do not market outside the United States.

    When you first visit any of the IPHF websites, you will be asked to consent to the use of cookies and similar technologies on the websites in accordance with this policy, and if you accept we will store cookies and similar technologies on your computer.

    1. Definitions

    IPHF.org is the interactive Web site operated on the Internet by Professional Photographers of America (IPHF), consisting of informational services and content provided by IPHF, affiliates of IPHF and other third parties. "Subscriber" means each person who establishes or accesses a connection ("Account") for access to and use of IPHF.org.

    2. General

    (A) This Agreement sets forth the terms and conditions that apply to use of IPHF.org by Subscriber. By using IPHF.org (other than to read this Agreement for the first time), Subscriber agrees to comply with all of the terms and conditions hereof. The right to use IPHF.org is personal to Subscriber and is not transferable to any other person or entity. Subscriber is responsible for all use of Subscriber's Account (under any screen name or password) and for ensuring that all use of Subscriber's Account complies fully with the provisions of this Agreement. Subscriber shall be responsible for protecting the confidentiality of Subscriber's password(s), if any.

    (B) IPHF shall have the right at any time to change or discontinue any aspect or feature of IPHF.org, including, but not limited to, content, hours of availability, and equipment needed for access or use.

    3. Changed Terms

    IPHF shall have the right at any time to change or modify the terms and conditions applicable to Subscriber's use of IPHF.org, or any part thereof, or to impose new conditions, including, but not limited to, adding fees and charges for use. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on IPHF.org, or by electronic or conventional mail, or by any other means by which Subscriber obtains notice thereof. Any use of IPHF.org by Subscriber after such notice shall be deemed to constitute acceptance by Subscriber of such changes, modifications, or additions.

    4. Disclaimer of Warranty; Limitation of Liability

    (A) Subscriber expressly agrees that use of IPHF.org is at subscriber's sole risk. Neither IPHF, its affiliates, nor any of their respective employees, agents, third party content providers, or licensors warrant that IPHF.org will be uninterrupted or error free; nor do they make any warranty as to the results that may be obtained from use of IPHF.org, or as to the accuracy, reliability or content of any information, service, or merchandise provided through IPHF.org

    (B) IPHF.org is provided on an "as is" basis without warranties of any kind, either express or implied, including, but not limited to, warranties of title or implied warranties of merchantability or fitness for a particular purpose, other than those warranties which are implied by and incapable of exclusion, restriction, or modification under the laws applicable to this agreement.

    (C) This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. Subscriber specifically acknowledges that IPHF is not liable for the defamatory, offensive, or illegal conduct of other subscribers or third parties and that the risk of injury from the foregoing rests entirely with subscriber.

    (D) In no event will IPHF, or any person or entity involved in creating, producing, or distributing IPHF.org, be liable for any damages, including, without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of or inability to use IPHF.org. Subscriber hereby acknowledges that the provisions of this section shall apply to all content on IPHF.org

    (E) In addition to the terms set forth above neither IPHF, nor its affiliates, information providers, or content partners, shall be liable regardless of the cause or duration, for any errors, inaccuracies, omissions, or other defects in, or untimeliness or unauthenticity of, the information contained within IPHF.org, or for any delay or interruption in the transmission thereof to the user, or for any claims or losses arising therefrom or occasioned thereby. None of the foregoing parties shall be liable for any third-party claims or losses of any nature, including, but not limited to, lost profits, punitive or consequential damages. IPHF, its affiliates, information providers, or content partners shall have no liability for investment decisions based on the information provided. Neither IPHF, nor its affiliates, information providers or content partners, warrant or guarantee the timeliness, sequence, accuracy or completeness of this information. Additionally, there are no warranties as to the results obtained from the use of the information.

    5. Monitoring

    IPHF shall have the right, but not the obligation, to monitor the content of IPHF.org, including chat rooms and forums, to determine compliance with this Agreement and any operating rules established by IPHF and to satisfy any law, regulation or authorized government request. IPHF shall have the right in its sole discretion to edit, refuse to post or remove any material submitted to or posted on IPHF.org. Without limiting the foregoing, IPHF shall have the right to remove any material that IPHF, in its sole discretion, finds to be in violation of the provisions hereof or otherwise objectionable.

    6. Indemnification

    Subscriber agrees to defend, indemnify, and hold harmless IPHF, its affiliates, and their respective directors, officers, employees, and agents from and against all claims and expenses, including attorneys' fees, arising out of the use of IPHF.org by Subscriber or Subscriber's Account.

    7. Termination

    Either IPHF or Subscriber may terminate this Agreement at any time. Without limiting the foregoing, IPHF shall have the right to immediately terminate Subscriber's Account in the event of any conduct by Subscriber which IPHF, in its sole discretion, considers to be unacceptable, or in the event of any breach by Subscriber of this Agreement.

    8. Third Party Content

    IPHF.org is a distributor (and not a publisher) of content supplied by third parties and Subscribers. Accordingly, IPHF has no more editorial control over such content than does a public library, bookstore, or newsstand. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, Subscribers or any other user of IPHF.org, are those of the respective author(s) or distributor(s) and not of IPHF. Neither IPHF nor any third-party provider of information guarantees the accuracy, completeness, or usefulness of any content, nor its merchantability or fitness for any particular purpose. (Refer to Section 4 above for the complete provisions governing limitation of liabilities and disclaimers of warranty.)

    In many instances, the content available through IPHF.org represents the opinions and judgments of the respective information provider, Subscriber, or other user not under contract with IPHF. IPHF neither endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made on IPHF.org by anyone other than authorized IPHF employee spokespersons or members of IPHF’s Board of Directors while acting in their official capacities. Under no circumstances will IPHF be liable for any loss or damage caused by a Subscriber's reliance on information obtained through IPHF.org. It is the responsibility of Subscriber to evaluate the accuracy, completeness, or usefulness of any information, opinion, advice, or other content available through IPHF.org. Please seek the advice of professionals, as appropriate, regarding the evaluation of any specific information, opinion, advice, or other content.

    9. Miscellaneous

    This Agreement and any operating rules for IPHF.org established by IPHF constitute the entire agreement of the parties with respect to the subject matter hereof, and supersede all previous written or oral agreements between the parties with respect to such subject matter. This Agreement shall be construed in accordance with the laws of the State of Georgia, without regard to its conflict of laws rules. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import.

    We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you.     Mailing List Registration

    In order to register for our mailing list, a user must first complete the registration form. During registration a user is required to give certain information (such as name and email address). This information is used to contact you about the products/services on our site in which you have expressed interest. At your option, you may also provide demographic information (such as gender or age) about yourself, but it is not required. You may opt out of any future contacts from us at any time by using the mailing list options provided or contacting us.

    We take precautions to protect your information. When you submit sensitive information via the website, your information is protected both online and offline. Wherever we collect sensitive information (such as credit card data), that information is encrypted and transmitted to us in a secure way. While we use encryption to protect sensitive information transmitted online, we also protect your information offline. Only employees who need the information to perform a specific job (for example, billing or customer service) are granted access to personally identifiable information. The computers/servers in which we store personally identifiable information are kept in a secure environment.

    Orders

    We request information from you on our order form. To buy from us, you must provide contact information (like name and shipping address) and financial information (like credit card number and expiration date). This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we’ll use this information to contact you.

    Sharing

    We share aggregated demographic information with our partners and advertisers. This is not linked to any personal information that can identify any individual person.We use a credit card processing company to bill users for goods and services. These companies do not retain, share, store or use personally identifiable information for any secondary purposes beyond filling your order.

    These third-party cookies fall into three categories:

    1. Advertising cookies: These cookies track your browsing behavior throughout IPHF websites and what you click through on IPHF emails in order to deliver content and ads more relevant to you and your interests. This targeting is based on what you have viewed on our websites and is known as Online Behavioral Advertising. The information contained in these cookies has NO personal identifier information (no email address, no name, no phone number, etc.) as it is all “anonymized”.     2. Retargeting cookies: You may notice that sometimes after visiting a website you see increased numbers of ads from the company you visited. This is because advertisers, including IPHF, pay for these interest-based ads, which are made possible by retargeting cookies. We use these interest-based ads to encourage U.S. based photographers who haven’t joined IPHF or attended Imaging USA yet, to come back to our websites. And just like for advertising cookies, the information contained in retargeting cookies has NO personal identifier information (no email address, no name, no phone number, etc.) as it is all “anonymized”.

    3. Tracking techniques other than cookies:

    o IPHF may use tracking techniques such as embedding URLs to allow use of the IPHF websites without cookies. Embedded URLs allow limited information to follow you as you navigate the sites, but are not associated with your personal data and are not used beyond each session.

    o IPHF and its service providers may also use embedded pixel tags for the purposes of identifying unique user visits (as opposed to aggregate hits) and for advertising purposes.

    o We may place pixel gifs, also known as beacons, in emails sent to our users. These are tiny graphic files that contain unique identifiers that enable us to recognize when our users have opened an email or clicked certain links. This action records each user’s IP address, email address, date, and time associated with each open/click for a campaign. We use this information to track our email campaigns’ responsiveness but never sell it to third parties.

    o We may use some widgets, which are interactive mini-programs that run on our sites to enable and track the effectiveness of buttons or tools on our websites. The widget, button or tool may collect and automatically send Personal Data, such as your e-mail address, or other Information (such as your browser information, or IP address) and information collected or used by a widget, button or tool, including cookie settings and preferences, is governed by IPHF’s privacy policy.

    It is worth noting that opting out of these third-party cookies or interest-based ads will not mean that you will stop seeing ads. Instead, the ads you will be served will no longer be tailored to you.

    • Do Not Track: Some Internet browsers - like Internet Explorer, Firefox, and Safari - include the ability to transmit “Do Not Track” or “DNT” signals.
